 Clarification Text on Processing and Protection of Personal Data

ART DECO Furniture Construction Contracting Industry and Tic. Ltd. Şti., we attach importance to the processing and preservation of personal data of all real persons associated with our company, including our valued customers and visitors who benefit from our products and services, in accordance with the Law No. 6698 on the Protection of Personal Data. As Data Controller, we would like to inform you about our data processing activity through this Clarification Text in accordance with the law and to inform you of your rights in this context.

What Processing of Your Personal Data Means.

Processing of personal data; It refers to all kinds of operations performed on data such as obtaining, collecting, recording, storing, preserving, changing, rearranging, disclosing, transferring, taking over, making it available, classifying or preventing its use, provided that these data are fully or partially automated or as part of any data recording system, by non-automatic means.

For which purposes your personal data are collected and processed.

Our company processes your personal data for the following purposes in order to provide the necessary information in order to fulfil contractual obligations in accordance with the Law and to fulfil its obligations.

1- To confirm the identity information of our customers who carry out product, service purchases and similar transactions personally or through a representative,

2-To communicate with the relevant persons in electronic or physical environment,

3- To fulfil the obligations undertaken in accordance with the provisions of the relevant legislation and the contracts to which it is a party and to apply for legal rights,

4-Execution of activities in accordance with the legislation,

5-To be able to provide information to authorised public institutions and organisations,

6- To realise membership registration,

7-To provide information to our customers, members and visitors on the website/mobile applications about our products and campaigns that they may be interested in line with their expectations and requests,

8-Organising surveys, conducting trend analyses and statistical analyses in electronic environment and/or physical environment personally or through contracted organisations in order to recognise our customers who shop on the website/mobile applications and otherwise, to use them in customer environment analysis, to use them in various marketing and advertising activities and to ensure customer satisfaction in this context,

9-To ensure the security of the website/mobile applications in order to provide a safer shopping environment,

10-Managing and executing the processes related to the orders created through the website / mobile applications and other means, finalising them, providing our customers with up-to-date information about their orders, sending SMS and E-Mail about the delivery status,

13-Legal affairs, follow-up and finalisation of requests and complaints.

Personal data collected by our company and the purposes of collection may vary according to the services provided and the contracts established.

With Who and For What Purposes Your Personal Data is Shared.

The sharing of personal data with third parties is carried out with the consent of the data subjects pursuant to Articles 8 and 9 of the Law, and as a rule, personal data are not transferred to third parties without the consent of the data subject. However, in some cases listed in the Law, it is stipulated that personal data may be shared without the consent of the person concerned.

In this context; In accordance with our obligations arising from the legislation, your personal data is shared with judicial authorities and other public institutions and organisations upon request. Personal data may be transferred to our contracted suppliers, legal advisors and affiliates in order to provide our products and services in the best way, to fulfil our contractual and legislative obligations, to monitor and audit the services provided, to resolve legal disputes, to carry out financial and accounting affairs, to ensure the security of our website-mobile applications and your personal data and to create a high-level shopping experience.

By which methods your personal data are collected.

Your personal data are collected and stored verbally, in writing or electronically through various channels such as our corporate website, mobile site or e-mail, SMS or other means or the information you transmit to us during the signing of commercial contracts and / or during the commercial relationship process, technical communication files called "cookies" (small files placed on your hard drive) that allow our servers to automatically recognise you during your visit to our website, physical forms; fully or partially by automatic means or by various non-automatic methods provided that they are part of the data recording system.

On Which Legal Grounds Your Personal Data is Processed.

As a rule, your explicit consent is required for the processing of your personal data. Explicit consent can be defined as the authorisation of the person concerned to be informed correctly on a specific and clear subject and to allow the transaction to be established in this regard. However, Article 5/2 of the Law specifies the cases where data can be processed without explicit consent. If at least one of these situations exists, data processing activities can be carried out without the consent of the data subject. Your personal data mentioned above are processed based on the following legal reasons specified in Article 5/2 of the Law:

2. It is mandatory for the data controller to fulfil its legal obligation,

3. Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject,

4. It is necessary to process personal data of the parties to a contract, provided that it is directly related to the conclusion or performance of the contract,

5. Data processing is mandatory for the establishment, exercise or protection of a right

What are the Rights of Personal Data Subjects under the Law.

Pursuant to Article 11 of the Law, data subjects are entitled to

1. To learn whether personal data about them are processed or not,

2. To request information if personal data has been processed,

3. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

4. To know the third parties to whom personal data are transferred domestically or abroad,

5. To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

6. Although it has been processed in accordance with the provisions of the Law and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

7. To object to the emergence of a result to the detriment of the person himself/herself by analysing the processed data exclusively through automated systems,

8. In case of damage due to unlawful processing of personal data, it has the right to demand the compensation of the damage.

You can send your request regarding your specified rights to our e-mail address given below via your registered e-mail address, using secure electronic signature, mobile signature or using your e-mail address previously notified by you and registered in our system. At the same time, you can hand-deliver a wet signed petition with documents identifying your identity to our registered mail address or send it through a notary public.

In the application that you have as a personal data owner and that you will make in order to exercise your rights mentioned above and that includes explanations regarding the right you request to exercise; the matter you request must be clear and understandable, the subject you request must be related to your person or if you are acting on behalf of someone else, you must be specifically authorised in this regard and this authorisation must be documented, and the application must contain your identity and address information.

 

Your personal data processed for the purposes specified in this Clarification Text will be deleted, destroyed or continued to be used by us by anonymising your personal data when the purpose that requires processing according to Article 7 / f.1. personal data protection of the Law disappears and / or when all periods, including the statute of limitations that we are obliged to process your data in accordance with the legislation, have expired.
